These Terms and Conditions set out the terms and conditions under which individuals may use the website and access the services offered by Operation Oasis.

These Terms and Conditions are a legally binding contract between you, the person accessing and using the site, and Operation Oasis. Please read it carefully. By accessing and/or using any portion of the Operation Oasis website, you are deemed to have read, understood and agreed to the terms and conditions set out below.

If you do not agree to all the Terms and Conditions set out below, you may not access or use the Operation Oasis website or associated services. 

Description of Service 

The Operation Oasis website (operationoasis.ca) serves to assist with matching families with student respite providers without a service fee (is a no fee service). Operation Oasis serves to assist with matching families with student service providers. The Operation Oasis Services on the Operation Oasis website (operationoasis.ca) allows interested families and student providers to fill-out intake forms to help facilitate matching of those users. 

Operation Oasis is not a part to the relationship between families seeking services and student service providers. Operation Oasis shall not in any way be liable to families or student service providers or any third party, arising directly or indirectly from employment or independent contractor agreement between the parties. 

Operation Oasis does not verify, review, evaluate, interview, screen or perform any background check on any of its users or the content provided by the users in the intake forms. You assume all risks associated with dealing with persons who you come in contact with through the services of Operation Oasis. 

We may change these terms at any time without notice, effective upon its update on the website. Please refer to the website regularly for information about services provided. Your continued use of the website is considered acceptance of any revised Terms and Conditions

Eligibility Criteria 

You must be at least 18 years of age or older to use this website or access any of the services offered through Operation Oasis. Services are to be used by parents or guardians of children with disabilities. We assume no responsibility or liability for any misrepresentation of your age. 

If you are signed up to be a student service provider, you must be legally permitted to work in the jurisdiction where you are seeking employment. 

No users may have ever been the subject of a complaint, restraining order or any other legal action or criminal offence involving violence, abuse, neglect, fraud, or any other offence that involves endangering the safety of others. You must not be registered or currently required to register as a sex offender with any government agency in any jurisdiction.

Personal Information 

You agree that your use of the Operation Oasis Website and Services is subject to the terms of our Privacy Policy, which is hereby incorporated into and forms an integral part of the Terms and Conditions. By using the Platform, you expressly consent to the collection, storage, use and disclosure of your information, including your Personal Information, according to the Privacy Policy

In these Terms and Conditions, ‘personal information” means any information about an identifiable individual, such as your name, child’s name, child’s age, child’s diagnosis, program information, email address, location and any other information you may choose to provide electronically through the Parent or Student Intake Forms that identifies who you are. Intake Data and Personal Information will be used by Operation Oasissolely in accordance with these Terms of Condition and Privacy Policy

You agree you will maintain and update such Intake Data as necessary in order to keep such information current, complete, and accurate. Failure to comply with this may result in immediate termination of your account.

You represent and warrant to Operation Oasis that you are at least 18 years of age and have been fully authorized to provide to Operation Oasis any and all Registration Data (including any Personal Information) for the purposes of these Terms of Use and that Operation Oasis is authorized and permitted to use such data as and to the extent provided in these Terms and Conditions and the Privacy Policy.

Content and Use of Services

As a Service Seeker (Parent), Service Provider (Student) or any other User of the Services, you agree that the content of information and materials you post on the Website is accurate, current and complete. In addition, you represent and warrant as follows: 

a.     You have the right and authority to post all information you post about yourself or others.

b.     You will not provide inaccurate, misleading, defamatory or false information to Operation Oasis or to any other User of the Website 

c.     You will not post any content (including, but not limited to, written material, text, photos, or graphical content) on the Website, or transmit to other users, that is defamatory, inaccurate, inappropriate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, defamatory, racially offensive, or illegal material, or any material that infringes or violates another party’s rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity), or advocate, promote or assist any unlawful act.

d.     Your use of the Website, and Services provided by Operation Oasis are in accordance with any and all applicable laws and regulations.

Use License

Operation Oasis hereby grants you a limited, non-exclusive, personal, non-transferable, non-sub-licensable and revocable right and license to:

a.    Access the website for the purpose of receiving the Services in accordance with these Terms and Conditions 

b.    Access, view and print any information and documentation made available on the Website, for your personal, non-commercial and informational use only to assist you in the access and use of the Website and the Services.

These Terms and Conditions do not grant you any other right or license, whether express or implied, by estoppel, or otherwise in or under any patent, trademark, copyright, or other intellectual property or proprietary right of Operation Oasis or any third party.

Operation Oasis may terminate this license at any time for any reason whatsoever.

Intellectual Property

The Website and all intellectual property rights in the Website are owned by Operation Oasis.

Operation Oasis reserves all intellectual property rights, including but not limited to, copyright, trade-marks, domain names, design rights, brand elements, database rights, patents, and all other intellectual property rights of any kind, whether registered or unregistered.
